Property Management Company:
The legal entity that owns or manages the property displayed on this website.

The information, content, materials, graphics, text, images, designs, trademarks, trade names and logos contained on this website are protected by trademark, copyright and other intellectual property laws under the laws of the United States and international treaties. Use of this site shall not be deemed as a transfer of rights in any such trademarks, copyrights or intellectual property.

Property Solutions International, Inc. (hereinafter PSI) does not guarantee uninterrupted or error-free operation of this site or any portion thereof and will use reasonable efforts to maintain its operation and availability.

3. Harmful Code
PSI does not warranty that any feature you download from this site will be free of viruses, contamination, or other potentially destructive features.

4. NO WARRANTY
All information and content on this website is provided "AS IS" and PSI makes no warranties (express, implied or otherwise) regarding its accuracy, currency, completeness, merchantability, performance or fitness for a particular purpose. Furthermore, no other oral or written communications shall be deemed to create a warranty with respect to use of this website.

5. Restrictions on Use of Site
You may use this website for your own personal or commercial purposes. The alteration, removal, or obliteration of any copyright and trademark notices is strictly prohibited. You shall not upload to, distribute through, or otherwise publish through, the Property Solution website any content that is libelous, defamatory, obscene, pornographic, threatening, invasive of privacy or publicity rights, abusive, illegal or otherwise objectionable, that would constitute or encourage a criminal offense or violate the rights of anyone, or that would otherwise give rise to liability or violate any law.

6. WAIVER AND RELEASE OF LIABILITY
YOUR ACCESS AND USE OF THIS WEBSITE IS AT YOUR OWN RISK. To the fullest extent permitted by law you hereby waive and release PSI for any and all claims, losses, costs or damages of any nature whatsoever resulting from or in any way related to your use of this website. It is intended that this limitation apply to any and all liability or cause of action however alleged or arising. PSI shall not be liable to you for loss of profit or revenue, loss of business opportunity, loss of use, product liability, or for any incidental, special, indirect, punitive or consequential damages arising out of or in connection with your use of this website. The Ratings and Reviews posted on the site are opinions and could be changed by a third party. If you choose to live at the property based on the ratings or reviews posted here, PSI is not liable for any actions arising from this service. Third parties will have access to view any ratings and reviews that you post on this site, and PSI is not liable for any actions or liability that may arise from this. PSI is not liable for the information contained in this site that is posted by third persons, and no warranties arise from this service, including if the information is false. This waiver and release shall apply to all claims, whether under the law of contract, equity, tort, strict liability or otherwise.

7. Disclosures
PSI reserves the right to disclose any information concerning your use of this website to the extent required by law or judicial or government order.

8. Indemnity
You may not use this website for any unlawful purpose, or for any purpose prohibited by these Terms of Use. You shall indemnify, defend and hold harmless PSI, it's officers, directors, shareholders, employees, affiliates, successors, assigns and contributors from any liability, loss, claim and expense (including reasonable attorney fees) related to your violation of these Terms of Use, and/or your posting or use of materials on or obtained from this website.

9. Privacy Policy
PSI holds the protection of client information to be very important. As part of your use of the website, you may provide PSI with personal information such as your name, business name and mailing address, telephone number, fax number, and e-mail address that will permit us to identify you. PSI will use all other personal information we collect from you only for purposes appropriate for conducting our business, including using it on other third party sites, providing the ratings and reviews you submit to third parties, follow up on services provided, sending announcements on new features, events, products or services, creation of a client database, audits, reporting requirements, and for other activities related to business administration, marketing, research, product development, or improving the quality of our services and products. Although we may collect and compile aggregate data about their transactions, PSI will not sell, give or otherwise make available to third parties any personally-identifiable information about you except as a part of any sale of assets, joint venture, merger or partnership or as required by law or judicial or governmental order.

10. Children
Nothing on this website is intended to specifically solicit information from minors (people under eighteen (18) years old) or seek to determine whether the visitor is a minor. If you are under eighteen (18), you are not permitted to submit to us any personally identifiable information, such as your name, address, email address, telephone number or any other information that would permit us to identify you. If you are under fourteen (14), it is against the law for us to ask you for that information, and we will not ask for it, nor do we want it. Anyone under 18 who wants to obtain any product from PSI or otherwise submit any personally identifiable information to us should ask a parent to do it in their own name. Because such information will not be specifically identified as being from minors, users of this website should be aware that personally identifiable information submitted to it by minors may be treated in the same manner as information given by an adult.

You should be aware that when you are on this website, you could be directed to other sites that are beyond our control. There may also be links to other sites from the website that take you outside our service. We do not always review those sites and we take no responsibility and assume no liability for any content in such sites, or for any mistakes, defamation, libel, slander, omissions, falsehoods, obscenity, pornography or profanity contained on such sites. Your linking to other sites, your use of such sites, and your use of any information, material, products and services offered by such sites, is solely at your own risk.

12. Non-waiver
Property Solution's failure to insist upon strict enforcement of any provision of these Terms of Use shall not be construed as a waiver of any provision or right.

13. Applicable Laws; Governing Law; Dispute Resolution
User access to this website is governed by all applicable federal, state and local laws. These Terms of Use shall be governed by and construed in accordance with the laws of the State of Utah, without giving effect to any principles of conflicts of law. Any dispute between you and PSI regarding the content or use of this website shall be resolved by arbitration under the Commercial Rules of the American Arbitration Association, with hearings held in the English language in Provo, Utah (Utah County) and shall not be joined with any dispute that any other person or entity may have with PSI.

Whereas PSI has provided the ability to translate this Agreement into languages other than English, this translation is provided for convenience only. Your relationship with PSI and the Property Management Company will be governed by the English language version of the Agreement and if there is any contradiction between the English language version and a translated version, the English language version shall take precedence.

Alert Management

Residents
If you are a resident of the property sending you text messages, you can manage all of your different notifications from within ResidentPortal^TM. Login to your property and go to your profile tab. Under the SMS settings block, click "Edit" and un-check the services you would like to opt-out of. Alternatively, you can manage which messages you would like to be subscribed to in the same place.

Non-residents
If you are a non-resident or resident, you have the following commands:

• Text HELP to 51378 for help via SMS message
• Text STOP to 51378 to learn the keyword and contact information for the property/properties you are subscribed to receiving text messages from.

FAQs

How did I get subscribed to your service?
There are two ways you can opt-in to our services. The first is via the web (on a form). The second is by texting a keyword to the shortcode, 51378.

Am I being charged for these messages?
That depends on the standard SMS rate plan you have setup with your carrier/provider. Neither Property Solutions nor a property involved in these messages is directly charging you to receive these messages. However, standard message and data rates do apply for our services.

Terms and Conditions
You must be 13 years or older to receive/send text messages in affiliation with any of these subscriptions. By your participation in these property subscriptions, you certify that you are at least 13 years of age and meet any other age and residency requirements of the property.

Unless specified otherwise on the site, users must be at least 13 years or older and a legal resident of the United States before participating in this text-messaging subscription. By your participation in our club, you certify that you are at least 13 years of age and meet any other eligibility and residency requirements of the specific property.

User acknowledges that SMS messages are distributed via third party mobile network providers and, therefore, the property cannot control certain factors relating to message delivery. User acknowledges that, depending on the recipient's mobile provider service, it may not be possible to transmit the SMS message to the recipient successfully. Please see the carriers section below for information on supported carriers.

Property does not claim or guarantee availability or performance of this service, including liability for transmission delays or message failures.

Fees
Neither your apartment complex nor property Solutions charges a fee for any of the subscriptions listed above. Message and Data Rates May Apply.

Frequency
User will receive up to 10 messages per month for all services. This varies by subscription level and resident status.

Participation in our service is free of charge but standard carrier text messaging charges will apply. You may change your mind at any time by following the opt-out instructions below. You represent that you are the owner or authorized user of the wireless device you use to sign up for the SMS Service, and that you are authorized to approve the applicable charges. PropertySolutions.com will never rent or sell your phone number to any third party, nor will we use your phone number to initiate a call or SMS message to you without your express or implied prior consent. Your wireless carrier and other service providers also collect data about your SMS usage, and their practices are governed by their own privacy policies.

You acknowledge and agree that the SMS Service is provided via wireless systems which use radios (and other means) to transmit communications over complex networks. We do not guarantee that your use of the SMS Service will be private or secure, and we are not liable to you for any lack of privacy or security you may experience.
